Are Major Online Poker Sites Breaking Australian Gambling Laws?

Laws in Australia prohibit residents from gambling online, specifically online poker. However there are many big time sites allowing Australian players to sign up and gamble. With the fines for such acts as high as $1.1 million a day it seems it’s not enough to deter them from taking well over $300 million in bets annually from the Aussies.

Big names like PokerStars, Full Tilt Poker and 888 Poker are just some of the big names currently in the Australian market. In addition, 888 Poker also uses Australian cricket star Shane Warne, boxing champ Jeff Fenech and AFL player Brendan Fevola as spokespeople who promote and advertise for the site.

Online betting company Betfair claims the rules are being blatantly ignored and as a result are costing the commonwealth in tax revenues. Fraudulent activity is also being argued as an issue of concern.

As stated by Betfair, offering Australian residents the ability to play online poker is illegal and causes revenue to move offshore without any taxes being paid. The online poker industry is also an unregulated industry with little protection against fraud and security.

There is no indication at this point if any action will be taken however Betfair is calling on the Australian government to regulate gambling so that companies can operate under license instead of in a free-for-all and uncontrolled arena.

And even though the laws against online poker gambling were drawn up almost 10 years ago this issue is still a hot one as others like Mark Zirnsak, the chair of the Interchurch Gambling Taskforce are calling for a complete ban on internet gambling, not just poker.

CryptoLogic and Online Betting Platform Betfair Team Up

At least 10 new, CryptoLogic games will be gracing the world’s largest online betting community, Betfair in 2009 as the two companies have signed a multi-year agreement.

CryptoLogic, a top, branded software provider to the online gaming community will provide Betfair with at least 10 of their branded and non-branded slot games. Betfair offers innovative products like casino games, exchange games and poker and also operate Betfair Poker, Tradefair and Betfair Predicts. The first five will be released to Betfair’s huge customer base of over 2 million before the end of the second quarter of 2009 while the other games will follow in the third and fourth quarters of 2009.

Brian Hadfield, CryptoLogic’s President and CEO said the new relationship between the two companies is excellent proof of CryptoLogic’s business strategy: ‘Build once, license often’. Hadfield also noted the agreement marks yet another top global gaming brand to join alongside CryptoLogic.

The relationship seems poised to succeed as this is not the first joint venture by the two companies. Both worked together as far back as 2004 when Betfair launched BetFairPoker.com using CryptoLogic’s licensed software subsidiary, WagerLogic Ltd.

And with years of experience on both sides of the table, the partnership is sure to see success as Betfair customers receive access to some of the top slot games available while CryptoLogic receives exposure to a huge customer base where nearly 6 million transactions are conducted each day.

Online Gambling Company Caught In Second Trademark Infringement Case In Two Years

Get caught once shame on you but get caught twice, now you’re really asking for it! Smart Answer, an Internet gambling operator has been charged with illegally using domain names from a Las Vegas casino company who claim the use of particular names as domains constitutes copyright infringement while intentionally deceiving players.

The Panama-based Internet gambling company, Smart Answer are facing charges from the Stations Casinos brand who are claiming that Smart Answers’ use of several website domain names like Palace Station, Boulder Station and Sunset Station are disrupting business intentionally by diverting traffic to their sites and essentially away from the Stations Casino sites.

Unfortunately and surprisingly this is not the first infringement lawsuit for Smart Answer who were ordered to pay $2.2 million in damages last year when they lost a case against MGM Mirage. Smart Answer was found guilty of using trademarked names like Bellagio, Circus Circus and Mandalay Bay. MGM Mirage eventually took over the disputed domain names, but never collected the money.

Stations Casinos are now looking to bar Smart Answer from using their branded names and are also seeking damages. The case is likely to be successful however it is highly unlikely as evidenced by the outcome of the MGM case that any monetary award will probably never be paid.
